What this platform is

Captive Feasibility is a modeling and analysis platform. It applies established actuarial methods to loss data you supply and produces projections, comparisons, and a report. It is software, and its output is only as good as the data entered into it.

What it is not — read this section

It is not a signed actuarial opinion. No credentialed actuary reviews, certifies, or signs the output. Nothing produced by this platform constitutes a statement of actuarial opinion within the meaning of the American Academy of Actuaries’ qualification standards or ASOP No. 41. Most domiciles require a feasibility study signed by a qualified actuary as part of a licence application, and this platform does not satisfy that requirement. It is designed to inform and accelerate that engagement, not replace it.

It is not legal advice. Whether a particular arrangement constitutes insurance for federal income tax purposes, and whether it involves adequate risk shifting and risk distribution, are legal determinations on your specific facts. Engage counsel.

It is not tax advice. The IRC § 831(b) diagnostics are deliberately conservative and cite their sources, and they carry an as-of date because this area of law has changed materially and recently. They are not a determination of your tax position and are not a substitute for advice from qualified tax counsel.

It is not a substitute for a regulator’s review. A domicile regulator applies its own judgement to a licence application, and nothing here binds or predicts that judgement.

Your responsibilities

You are responsible for the accuracy and completeness of the data you enter. Loss runs should come from your carrier or broker rather than from memory. Garbage in, confidently formatted garbage out — and the confident formatting is the dangerous part.

You are responsible for obtaining professional advice before forming any captive or making any risk-financing decision. A report from this platform is an input to that decision, never the decision itself.

Our independence, stated as an obligation

We take no formation fee, no captive management contract, no commission on any placement, and we maintain no office in any domicile. There is no arrangement under which we earn more by recommending that you proceed. This is a term of service and not merely a marketing claim: if it ceased to be true, this page would have to change, and the independence argument on the front page would have to come down with it.

Fees

A single feasibility study is $2,500. A platform license is $4,999 per year. PCC network membership is $9,999 per year. The fee is the same whether the analysis recommends proceeding or recommends against it.

Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to your use of the platform is limited to the fees you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, consequential, or lost-profit damages.

This limitation is not an attempt to disclaim responsibility for doing the work properly. It reflects the reality that a modeling platform cannot underwrite the consequences of a capital decision it did not make and cannot control.

Availability and changes

We aim to keep the platform available and its regulatory data current, and every regulatory output carries an as-of date so you can see when it was last verified. We do not guarantee uninterrupted availability.

We may change these terms. Material changes will be reflected in the date at the top of this page. Continuing to use the platform after a change constitutes acceptance of it.

Governing law

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles.

Captive Feasibility

An independent captive feasibility platform. We take no formation fee, no management contract, and no commission, and we maintain no office in any domicile. There is no arrangement under which we earn more by recommending that you form a captive.

Important. Captive Feasibility is a modeling and analysis platform. Its outputs are not a signed actuarial opinion, not legal advice, and not tax advice. No output of this platform substitutes for a qualified actuary’s signed opinion, for counsel licensed in the relevant jurisdiction, or for a domicile regulator’s own review. Regulatory figures carry an as-of date; law changes, and a stale figure is a wrong figure. Verify current requirements with the domicile and with your own advisers before committing capital.
